Generally the biggest difference comes down to due diligence. Residential purchases deal with general inspections which is typically a quick one day inspection. Residential purchases are also cheaper and are more likely a homestead. Residential deals are emotional purchases that can usually be closed withing 30-45 days. Commercial property purchases involve property that is being used for business purposes, so there is more liability in the property and the land connected to it. The inspection process is extremely extensive, depending on prior usage, so the feasibility period is much longer and closing on commercial real estate deals can be a very long process.

We are a housing society registered under WB AOA ACT 1972. Can we approach a consumer court for recovery of dues from residents and owners who have been defaulting on their maintenance payments or we have to file a civil suit in a lower court only

1) The Promoter is maintaining the common area facilities for 33 Towers & 1875 Flats in Kolkata, West Bengal since more than 10 years. Now, to expedite the registration of Apartment owners Association where many owners are non residents, the promoter has proposed to register the Association as solo owner, since they are also owning flats in the complex. Please confirm its legal validity. 2) The Promoter added few constructions like multi level parking, temple etc which are not reflected in the site plan although Form A includes these items. Is it not required as per WB Apartment Owners' Association Act, 1972 to submit "As Built Drawing" which should perfectly match with the contents of Form A ?

My question is I live in an apartment and there are 8 flats. There is Tank which supplies iron water as I live in Garia , Kolkata , West Bengal. From the Tank 2 main pipes and 8 sub pipes supplies water to each flat. One of the pipe which supply water to my bathroom is clogged by iron water and water supply is stopped. Now the question is who will pay the money Me or the society ?
